These Terms of Service ("Terms") govern your use of cheercade.com and any products you order from Cheercade ("Cheercade", "we", "us"). By using our site or placing an order, you agree to these Terms.

1. Our Services

Cheercade creates personalized retro pixel‑art games in which you and your loved ones become characters in a custom browser game. You may also order physical prints (poster or canvas) of the game's artwork that include a QR code and link to play. Each order is personalized and made to order based on the photos and details you provide.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You are responsible for keeping your order details and email accurate.

3. Your Personalization Responsibilities

By uploading a photo or other content, you confirm that:

• You own the photo, or have explicit permission from the people in it and the copyright holder, to use it.
• The content does not contain illegal material or violate any third party's rights, and everyone shown has consented to their likeness being used.
• All information you provide, including your shipping address, is accurate and complete.

4. License to Use Your Content

You keep ownership of the photos and content you upload. You grant Cheercade a limited, non‑exclusive license to store and use that content solely to create, produce, deliver, support, and (if needed) reprint your order. We do not claim ownership of your photos and do not use them in our own advertising without your permission. See our Privacy Policy for how we handle this data.

5. Intellectual Property

The Cheercade game engine, templates, artwork styles, characters, software, and website are the property of Cheercade and are protected by intellectual‑property laws. Your finished, personalized game and prints are licensed to you for personal, non‑commercial use. You may not resell, redistribute, or commercially exploit our templates, software, or artwork.

6. Prohibited Content

You agree not to upload or request the creation of content that:

• Contains nudity, sexual, or sexually suggestive material.
• Depicts violence, gore, or harmful content.
• Constitutes hate speech or discrimination based on race, religion, gender, sexuality, disability, or national origin.
• Infringes any third party's intellectual property, privacy, or publicity rights, or uses someone's likeness without consent.
• Is illegal in your country of residence.

We may reject, cancel, or refuse any order that violates these rules, and may suspend repeat offenders.

7. Orders, Pricing & Payment

Prices and any applicable taxes and shipping are shown at checkout. Payment is processed by our payment providers. We may cancel and refund an order if we cannot fulfill it or if it violates these Terms.

8. Delivery

Your digital game is delivered by a play link after your payment is confirmed. Physical products are made to order, typically produced within 2–3 business days, and shipped according to our Shipping Policy.

9. Refunds & Replacements

Because every order is personalized and made to order, refunds and replacements are handled as described in our Refund & Replacement Policy. If something is wrong with your order, contact us and we will make it right.

10. Disclaimers & Limitation of Liability

Our services and products are provided "as is" without warranties of any kind, to the fullest extent permitted by law. Screen previews may differ slightly from printed colors. To the maximum extent permitted by law, Cheercade's total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential damages.

11. Governing Law

These Terms are governed by the laws applicable at Cheercade's principal place of business, without regard to conflict‑of‑laws rules. Any disputes will be handled in the courts of that jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the site after changes means you accept the updated Terms.
